CaseChat Overview and Summary
The primary legal issues before the Commission were whether the agreement complied with the requirements of the Fair Work Act 2009 and whether it met the "better-off, overall test." This test ensures that employees are not worse off overall by the terms of the agreement. The Commission had to assess if the proposed agreement provided a fair and reasonable outcome for all parties involved.
The Commission considered the evidence presented by both parties and examined the provisions of the agreement. It found that the proposed agreement met the legal requirements and passed the better-off, overall test. Consequently, the Commission approved the Re-Event Pty Ltd Enterprise Agreement 2015. The decision was based on the conclusion that the agreement provided a fair and reasonable outcome for all employees and the company.
The final orders included the approval of the agreement, which will now be in effect and govern the employment relationship between Re-Event Pty Ltd and its employees.
