CaseChat Overview and Summary
The court had to determine whether the agreement complied with the Fair Work Act 2009, particularly with respect to procedural fairness, and whether it met the criteria for being a "better off overall test" agreement. The central issue was whether the agreement was made in good faith and whether it provided a safety net for employees, ensuring they were not worse off than under the applicable award.
The commission examined the process of negotiations, the terms of the agreement, and the evidence presented by both parties. It found that the applicant had acted in good faith and that the agreement provided a safety net for employees. The commission also concluded that the agreement met the better off overall test. The unions' concerns about procedural fairness were addressed, and the commission found that the process was fair and transparent. Consequently, the commission approved the agreement, finding it met the statutory requirements under the Fair Work Act 2009.
The final orders of the commission were that the RCR O'Donnell Griffin Pty Ltd Service Enterprise Agreement (WA) 2013-2016 was approved as a registered agreement under the Fair Work Act 2009. The agreement was to commence on the first day of the third month after the date of the decision and would remain in effect until the end of the third year from that date, unless terminated earlier in accordance with the agreement or the Act.
