Ranchie and Best

The dispute between Ranchie (Applicant) and Best (Respondent) concerned the division of property. The matter came before Judge Brewster in the Australian Capital Territory.

The court was required to determine how the parties' interests in a property located at Property R, ACT, should be divided, and how a mortgage secured over that property should be handled. Additionally, the court needed to decide how personal property and choses in action held by each party should be treated.

Judge Brewster ordered that the Applicant must immediately transfer his entire interest in the property to the Respondent. This transfer was to occur simultaneously with the Respondent discharging the existing mortgage on the property or securing the release of the Applicant from liability under that mortgage. Furthermore, the court ruled that each party would be permitted to keep any chattels currently in their possession and any choses in action registered in their respective names.
