CaseChat Overview and Summary
The primary legal issue before the court was whether the agreement complied with the procedural requirements of section 232 of the Act, which mandates that an enterprise agreement must be approved by a majority of the employees in each relevant bargaining unit. The court also needed to determine if the agreement provided adequate protections for employees and did not contravene any other provisions of the Act.
The court found that the application for approval was properly made and that the agreement had been negotiated in good faith. The court was satisfied that the agreement was made in accordance with the procedural requirements of the Act. It concluded that the agreement provided sufficient protections for employees and did not contravene any other provisions of the Act. Consequently, the court approved and registered the agreement.
The final orders of the court were that the RJ Vincent and Co Roy Hill AWU Greenfields Agreement 2013 be approved and registered under section 186 of the Fair Work Act 2009. The Australian Workers' Union's application to intervene was dismissed.
