CaseChat Overview and Summary

The Administrative Appeals Tribunal considered the case of Mr. Rakhra concerning the cancellation of his Partner (Provisional) (Class UF) visa, Subclass 309. The dispute arose because Mr. Rakhra had been found guilty of a criminal offence and fined, although no conviction was recorded. The Department of Home Affairs had cancelled his visa on the basis of this finding.

The primary legal issue before the Tribunal was whether the finding of guilt and imposition of a fine, without a recorded conviction, constituted a "conviction" for the purposes of the Migration Act 1958 (Cth) and therefore a valid ground for visa cancellation under section 116(1)(g). The Tribunal had to determine if the provisions of the relevant state Sentencing Act, which stipulated that such a finding was not to be taken as a conviction for any purpose, had any bearing on the interpretation of the Migration Act.

The Tribunal reasoned that the Migration Act did not contain any specific provision that would allow it to distinguish between a finding of guilt with a fine and no conviction recorded, and a formal conviction. Therefore, it was bound to consider the state Sentencing Act's effect. As the state Act explicitly stated that the finding was not to be taken as a conviction for any purpose, the Tribunal concluded that the ground for cancellation under section 116(1)(g) of the Migration Act was not made out.

Consequently, the Tribunal was not satisfied that the ground for cancellation existed, meaning the power to cancel Mr. Rakhra's visa did not arise. The Tribunal set aside the decision under review and substituted a decision not to cancel the applicant’s Subclass 309 visa.
