The Court also noted that Mr. Rahman's solicitors had difficulty locating him, which further complicated the issue of communication.
The Court concluded that the deemed receipt of the notice under the Regulations did not equate to the genuine opportunity required by the statute. The failure of the RRT to ensure that Mr. Rahman was properly informed about his opportunity to give evidence constituted a breach of s 425(1)(a) of the Migration Act. Consequently, the Court set aside the RRT’s decision and remitted the matter to the RRT, constituted differently, for redetermination according to law. Additionally, the Court ordered the Minister to pay Mr. Rahman’s costs of the proceedings.
