CaseChat Overview and Summary

RAC Insurance Pty Limited, trading as RAC Insurance, sought approval of the RAC Insurance Enterprise Agreement 2017 from the Fair Work Commission. The matter was heard by Deputy President R P Smith. The applicant argued that the agreement should be approved as it was fair and reasonable, and met the criteria under the Fair Work Act 2009.

The legal issues before the court centred on whether the agreement complied with the requirements of the Fair Work Act. Specifically, the court had to consider if the agreement was in the public interest, whether it provided for fair and reasonable terms and conditions, and if it did not undermine the right to freedom of association. The court also examined if the agreement provided for an effective mechanism for dispute resolution.

The court found that the agreement was fair and reasonable, and in the public interest. It provided for appropriate terms and conditions and did not undermine the right to freedom of association. The agreement also provided for an effective mechanism for dispute resolution. Deputy President R P Smith approved the agreement on the basis that it met the criteria under the Fair Work Act.

The Fair Work Commission approved the RAC Insurance Enterprise Agreement 2017. The decision provides guidance to employers and employees in relation to the approval of enterprise agreements under the Fair Work Act.
