Quirk and Lake

The case of *Quirk and Lake* concerned an application by the husband to restrain the wife's solicitors from continuing to act in family law proceedings, and the wife's subsequent application for costs of those proceedings. The matter came before Rees J.

The primary legal issue before the Court was whether the wife's solicitors should be restrained from acting for her, and if not, the appropriate orders for costs in relation to that application.

Rees J determined that the wife's solicitors should not be restrained from acting. Consequently, the Court ordered that the husband pay the wife's costs of the application to restrain her solicitors and her application for costs of those proceedings, on a party and party basis.
