CaseChat Overview and Summary

This case involved an application by the State of Queensland and South Bank Corporation for leave to amend their defence in proceedings brought by JL Holdings Pty Ltd. The amendment sought to add a defence based on the argument that the Minister was not obliged to endorse the approval on the lease submitted for endorsement because the lease did not accord with the terms and conditions approved by the Minister under section 343 of the Land Act 1962 (Qld). The primary judge refused leave to amend on the basis that the amendment had the potential to require substantial issues of fact to be raised by way of reply, and that this would likely result in the trial date being vacated. The applicants sought leave to appeal this decision. The Full Court considered whether the primary judge's decision was attended with sufficient doubt to warrant reconsideration, and whether the refusal of leave to amend was attended with substantial injustice. The Court found that the primary judge had erred in principle by focusing on the prejudice to the applicant of a delay in the hearing, and not adequately weighing the potential injustice to the respondents of being precluded from raising the proposed defence. The Court granted leave to appeal, but found that the appeal should be dismissed. The Court held that the potential injustice to the respondents in not being permitted to introduce the proposed defence should have been weighed against the prejudice to the applicant flowing from the anticipated delay in the hearing. However, the situation could be remedied by imposing rigorous conditions on the amendment, such as ordering the respondents to pay all additional costs incurred by the applicant as a result of the amendment.
