CaseChat Overview and Summary

Quality Bakers Australia Pty Limited, trading as Goodman Fielder Australia, applied to the Fair Work Commission for approval of a new enterprise agreement with the United Workers Union. The dispute centred on the terms and conditions of employment, including wages, working hours, and other employment-related matters for employees in the baking industry in Tasmania. The application was heard by the Full Bench of the Fair Work Commission.

The legal issues before the court included whether the agreement complied with the relevant provisions of the Fair Work Act 2009, particularly whether the agreement had been made fairly and in good faith. The court also considered whether the agreement provided for procedural fairness, whether the union had been appropriately consulted, and whether the agreement was in the best interests of the employees.

The Full Bench determined that the agreement met the legal requirements for approval. The court found that the agreement had been made in good faith and was procedurally fair. The union had been appropriately consulted, and the terms of the agreement were in the best interests of the employees. The court was satisfied that the agreement provided for fair and reasonable terms and conditions of employment and approved the application for the Goodman Fielder Baking (Tasmania) and United Workers Union Agreement 2025-2028.
