CaseChat Overview and Summary
The court was tasked with determining if the agreement was made in good faith, whether it contained only permissible provisions, and if it complied with the relevant sections of the Fair Work Act. Specifically, the court examined whether the agreement provided fair and reasonable terms and conditions, and if the process leading to its creation adhered to the requirements for enterprise agreements. The court also considered the arguments from both parties regarding the fairness and practicality of the proposed terms.
In its decision, the Fair Work Commission found that the agreement did meet the legal standards for approval. The commission emphasised that the terms of the agreement were fair and reasonable, providing a balance between the interests of the employer and the employees. The commission also noted that the process leading to the agreement was conducted in good faith, with adequate consultation and negotiation between the parties. As a result, the court approved the Goodman Fielder Baking (Western Australia) Enterprise Agreement 2017-2019.
