[4] The undertakings meet the requirements of s.190(3) of the Act and I have accepted them. As a result, the undertakings are then to be a term of the Agreement and are attached to this Decision as Attachment A.

CaseChat Overview and Summary

Protek Carpentry and Fencing Services Pty Ltd, trading as Protek 247 Building and Maintenance Services, sought approval for the Protek 247 Building and Maintenance Enterprise Agreement 2020. The matter was heard in the Fair Work Commission, where the parties engaged in a dispute regarding the terms and conditions of the proposed agreement. The application was brought forth to obtain the Commission's approval, ensuring the agreement met the necessary legal standards and requirements under the Fair Work Act 2009.

The legal issues before the court centred on whether the proposed agreement complied with the statutory provisions of the Fair Work Act. Specifically, the court needed to determine if the agreement adequately covered the terms and conditions of employment, including wages, hours of work, leave entitlements, and other matters, in line with the legislative framework. Furthermore, the court had to assess whether the agreement was fairly negotiated and if it included appropriate dispute resolution mechanisms.

The Commission meticulously reviewed the agreement, considering the submissions from both parties. It found that the agreement was comprehensive and included provisions that aligned with the statutory requirements of the Fair Work Act. The court was satisfied that the agreement was fairly negotiated and provided for appropriate dispute resolution mechanisms. Consequently, the Commission approved the Protek 247 Building and Maintenance Enterprise Agreement 2020, affirming its compliance with the necessary legal standards.

The final orders of the Commission included the approval of the Protek 247 Building and Maintenance Enterprise Agreement 2020, effective from the date of the decision. The agreement was deemed to be a lawful and binding instrument governing the terms and conditions of employment for the employees covered by the agreement.
