CaseChat Overview and Summary
The primary legal issue before the Fair Work Commission was whether the enterprise agreement complied with the Fair Work Act 2009. The Commission had to determine whether the agreement met the requirements for good faith bargaining and whether it contained provisions that were contrary to public policy or not genuinely agreed upon by the parties. Additionally, the Commission considered whether the agreement adequately covered the rights and obligations of the employees and the employer.
The Fair Work Commission found that the agreement was made in good faith and did not contravene any public policy. The Commission was satisfied that the parties had genuinely agreed upon the terms of the agreement. The Commission noted that the agreement contained provisions that were consistent with industry standards and provided adequate protections for the employees. The Commission approved the enterprise agreement, finding that it met the requirements of the Fair Work Act.
The Fair Work Commission approved the Prosegur Australia Pty Limited, Kensington Depot Armoured Vehicle Operators’ Enterprise Agreement 2021-2024, effective from 1 July 2021 for a period of three years. The agreement provides for the terms and conditions of employment for armoured vehicle operators at the Kensington depot, including provisions for wages, hours of work, leave entitlements, and dispute resolution mechanisms. The agreement also includes provisions for the establishment of a joint health and safety committee and a training and development program for employees.
