Proclamation under the Valuation of Land Amendment Act 2006 (TAS)

The Tasmanian government issued a proclamation under the Valuation of Land Amendment Act 2006, setting 1 January 2007 as the commencement date for the Act. This proclamation was signed by the Governor on 20 December 2006, and was administered by the Department of Primary Industries and Water. The Act was notified in the Gazette on 27 December 2006.

The court was required to consider the validity of the proclamation and whether the Governor had the authority to issue it under the Act. The court also had to determine whether the Act was properly passed by the Tasmanian Parliament and whether it complied with constitutional requirements.

The court found that the Governor did have the authority to issue the proclamation under the Act, and that the Act was properly passed by the Parliament. The court also found that the Act was consistent with the Tasmanian Constitution. The court therefore upheld the validity of the proclamation and the commencement of the Act on 1 January 2007.
