Prior & Prior

In the matter of *Prior & Prior*, Benjamin J of the Family Court of Australia considered an application for leave to commence adoption proceedings concerning a child, Z, born in August 2001, by Mrs Prior and Mr Prior.

The central legal issue before the Court was whether to grant leave pursuant to section 60G of the *Family Law Act 1975* (Cth) for the adoption proceedings to be commenced.

Benjamin J granted leave for the adoption proceedings to be commenced. The Court also ordered that the proceedings be removed from the list of pending cases and certified that it was reasonable to engage counsel to attend, pursuant to Rule 19.50 of the *Family Law Rules 2004* (Cth).
