CaseChat Overview and Summary
The Commission examined the process through which the agreement was negotiated, the contents of the agreement, and the compliance with relevant procedural requirements. It was noted that the parties had engaged in extensive negotiations and had made a genuine effort to reach an agreement. The contents of the agreement were scrutinised to ensure they provided adequate protections for employees and did not unfairly disadvantage any party. The Commission also considered whether the mandatory provisions of the Fair Work Act had been adequately addressed within the agreement.
After reviewing the evidence and arguments presented, the Commission determined that the agreement was made in good faith, provided for appropriate workplace conditions, and complied with the statutory requirements for approval. The Commission approved the Primo Moraitis Fresh Pty Ltd and National Union of Workers Enterprise Agreement 2013. The approval ensures that the terms and conditions set out in the agreement will be legally binding on the parties involved.
