The Family Court of Australia, presided over by Dessau J, considered a dispute between a husband and wife concerning financial matters. The proceedings involved applications for the disclosure of documents, the execution of a power of attorney, and the taking of evidence abroad.

The court was required to determine several legal issues, including the wife's entitlement to a portion of funds held in trust, the husband's obligation to provide documentation relating to specific bank cheques, and the necessity and scope of a power of attorney to facilitate investigations into the disposition of funds in Spain. The court also addressed procedural matters such as the dismissal of the husband's response, the vacation of a trial date, and the granting of leave for various filings and amendments.

In reaching its decision, Dessau J applied principles relating to the division of matrimonial property and the court's power to order disclosure and facilitate the gathering of evidence. The court ordered that a sum of $100,000 be paid from trust funds to the wife, and that the husband provide copies of documents pertaining to specified cheques. Furthermore, the husband was ordered to sign a power of attorney to enable his wife's solicitors to investigate funds in Spain, and the court facilitated the process of requesting evidence from Spain under the Convention on the Taking of Evidence Abroad. The husband was also ordered to pay the wife's costs of the hearing.
