In the matter of *Porter & Porter*, Benjamin J of the Family Court of Australia considered an application by the wife for periodic and lump sum spousal maintenance. The court had previously made interim orders requiring the husband to pay the wife interim spousal maintenance. The wife's application for a lump sum spousal maintenance payment was dismissed.

The primary legal issue before the court was whether to grant the wife's application for lump sum spousal maintenance, in addition to the existing interim periodic maintenance order. The court was also required to determine the terms of any ongoing interim maintenance.

Benjamin J made orders for the husband to pay the wife $850 per week, calculated on a monthly basis and payable monthly in advance. All other applications within the wife's application in a case were dismissed. The court noted that the existing order was interim and that either party could return to court regarding document production once preliminary reports from Ms B were available. Costs were reserved for both parties.
