Porciello and Secretary, Department of Employment

This matter concerned an appeal by Mr Porciello against a decision of the Secretary, Department of Employment, which affirmed a delegate's refusal to grant him an advance under the Fair Entitlements Guarantee Act. The refusal was based on the finding that Mr Porciello's claim had been lodged more than 12 months after the relevant insolvency event.

The court reasoned that to be eligible for an advance, a claimant must lodge an effective claim, as defined by section 14 of the Act. This section mandates that the claim be on an approved form, accompanied by specified documents, and lodged within the prescribed time. The Act does not grant the Secretary or the Tribunal the power to extend these time limits. Mr Porciello's claim form required a certified copy of an Australian passport, birth certificate, or citizenship certificate, which he did not provide. Furthermore, the insolvency event occurred on 24 September 2014, meaning the 12-month claim period expired on 25 September 2014. Mr Porciello's claim, lodged on 16 March 2016, was therefore out of time. The court found that the claim form itself contained internal inconsistencies regarding the date of lodgement and the description of events, indicating it was not a true copy of an earlier lodged claim.

The court affirmed the decision under review, finding that Mr Porciello had not lodged an effective claim within the time prescribed by the Fair Entitlements Guarantee Act.
