Poon v Poon

The matter before the Court was an action brought by the plaintiff, Poon, against the defendant, Poon. The plaintiff sought to recover moneys allegedly advanced to the defendant. The central dispute in the case was whether the moneys advanced by the plaintiff were a personal loan to the defendant or whether they were lent to the defendant by the plaintiff's mother. The plaintiff also made an alternative claim in restitution. The case was heard in the Supreme Court of New South Wales.

The legal issues the Court had to determine were whether the plaintiff had indeed lent the moneys to the defendant and, if so, the amount of the loan. Additionally, the Court had to decide whether the plaintiff's claim in restitution was valid. The Court also had to consider the identity of the true lender, as the defendant argued that any loan was made by the plaintiff's mother rather than by the plaintiff himself.

The Court found that the plaintiff had indeed lent money to the defendant. It was determined that the plaintiff's mother was not the lender, and therefore the plaintiff was entitled to recover the amount of the loan plus interest. The Court also found in favour of the plaintiff on the claim in restitution. The Court ordered judgment for the plaintiff and directed that the parties bring in Short Minutes of Order reflecting these reasons and updating the interest claim of the plaintiff. The defendant was ordered to pay the plaintiff's costs of the proceedings as agreed or assessed, with liberty reserved to the parties to apply for a variation of the costs order. The exhibits were to be returned after 28 days.
