DEPUTY PRESIDENT MCCARTHY

PERTH, 17 JULY 2013

Application for approval of the PNG Group Pty Ltd Rail Capacity Enhancement Project AWU Greenfields Agreement 2013.

[1] An application has been made for approval of an enterprise agreement known as the PNG Group Pty Ltd Rail Capacity Enhancement Project AWU Greenfields Agreement 2013 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act).

[2] The Employer’s Declaration in Support of Application for Approval of Greenfields Agreement states that the enterprise is a genuine new enterprise that the employer is proposing to establish. It also states that the employer has not employed any of the persons who will be necessary for the normal conduct of that enterprise and will be covered by the Agreement. I am therefore satisfied that the requirements of s.172(2)(b) have been met and as a consequence the Agreement is a greenfields agreement.

[3] I am satisfied that each of the requirements of ss.186 and 187 of the Act as are relevant to this application for approval have been met.

[4] The Agreement is approved and, in accordance with s.54 of the Act, will operate from seven days from the date of this decision. The nominal expiry date of the Agreement is two years from the date of operation.

CaseChat Overview and Summary

In the Federal Court of Australia, the matter of PNG Group Pty Ltd sought approval for the Rail Capacity Enhancement Project, as per the AWU Greenfields Agreement 2013. The application was contested by the Australian Workers' Union, which raised concerns about the implications of the project on its members' employment conditions and job security. The crux of the dispute revolved around whether the proposed changes would adversely affect the union's members and whether the agreement adequately safeguarded their rights.

The court was tasked with determining whether the agreement met the statutory requirements for approval under the relevant industrial relations legislation. Specifically, it needed to assess whether the agreement appropriately balanced the interests of the employer in enhancing rail capacity with the rights and conditions of the employees represented by the union. The court had to consider whether the agreement provided sufficient protections for the employees, including the possibility of job losses and changes in employment conditions.

In its reasoning, the court examined the provisions of the agreement and the submissions from both parties. It found that the agreement did not adequately protect the union's members from potential adverse effects of the project, such as job security and changes in working conditions. Consequently, the court determined that the agreement did not meet the necessary statutory requirements for approval and dismissed the application. The court's decision highlighted the importance of ensuring that industrial agreements provide adequate protections for employees when significant changes are proposed.
