CaseChat Overview and Summary
The primary legal issue the Commission had to address was whether the agreement contained terms and conditions that complied with the provisions of the Fair Work Act. This involved assessing whether the agreement met the "better-off-overall test", which required the Commission to be satisfied that the employees would be better off overall under the agreement than they would be under the applicable award or safety net. Additionally, the Commission needed to determine if the agreement had been made genuinely and in good faith, and whether it adhered to the procedural requirements set out in the legislation.
In reaching its decision, the Commission considered the evidence presented and the arguments made by both parties. It found that the agreement did indeed meet the better-off-overall test and was made in good faith. Furthermore, the Commission was satisfied that all procedural requirements had been met. Consequently, the Commission approved the agreement, confirming that it was fair and compliant with the Fair Work Act.
The Fair Work Commission approved the PM Switchboards Enterprise Agreement 2013, finding it met the legal requirements under the Fair Work Act. The Commission determined that the agreement satisfied the better-off-overall test, was made in good faith, and adhered to all procedural requirements.
