Ping and Truang

The parties to this proceeding were a husband and wife. The wife sought to set aside a financial agreement. The matter came before Foster J.

The central legal issue before the court was whether the financial agreement should be set aside.

Foster J ordered that the husband pay the wife's costs of and incidental to the application to set aside the financial agreement. These costs were to be agreed within one month or, failing agreement, assessed on a party/party basis and paid within one month of assessment or agreement.
