The Administrative Appeals Tribunal considered an application for a Visitor (Class FA) visa, Subclass 600 (Visitor) (tourist stream), made by an applicant who had provided criminal history checks from Australia, Singapore, and the United Kingdom. The primary dispute concerned whether the applicant met the character requirements for the visa, specifically Public Interest Criterion (PIC) 4001, and whether the applicant had complied with Regulation 2.03AA by providing requested police clearance documents.

The Tribunal was required to determine two key legal issues: first, whether the applicant satisfied PIC 4001, which mandates that a visa applicant pass the character test or that the Minister is satisfied in specific alternative circumstances; and second, whether the applicant met Regulation 2.03AA, which requires the provision of appropriate police clearance documents when requested by the Minister or their delegate. The delegate had initially refused the visa on the grounds that the applicant had not provided the requested statements regarding his criminal history from the relevant authorities.

In its reasoning, the Tribunal noted that while the delegate had not received the required statements at the time of the initial decision, the applicant had subsequently provided a UK Police Certificate indicating "No Trace," a Singapore Police Force Certificate of Clearance confirming no criminal record, and an Australian Federal Police National Police Certificate stating no disclosable court outcomes. Based on this evidence, the Tribunal found that the applicant satisfied the character test and therefore met PIC 4001. Furthermore, the Tribunal was satisfied that the applicant had complied with Regulation 2.03AA by providing the requested documents from appropriate authorities. Consequently, the Tribunal remitted the application for reconsideration with a direction that the applicant met PIC 4001 and Regulation 2.03AA(2) for the purposes of clause 600.213(1) of Schedule 2 to the Regulations.
