Picano & Walkner

In the matter of *Picano and Walkner*, heard by Judge W J Neville on 25 June 2021, the dispute concerned the schooling arrangements for a child, X, born in 2009. The applicant, Mr Picano, and the respondent, Ms Walkner, were the parents of the child.

The primary legal issue before the court was to determine which school child X would attend for their primary school education. The court was also required to make orders regarding the enrolment process and the sharing of school fees.

Judge Neville ordered that, in the absence of any other written agreement, child X was to attend B School from the commencement of Term 1, 2022. Both parents were directed to take all necessary steps to enrol X at B School, ensuring both were listed as enrolling parents and emergency contacts for school and extracurricular activities. The court also noted that, unless otherwise agreed in writing, school fees were to be shared equally between the parties. The mother's costs in relation to the schooling application were reserved.
