COMMISSIONER CIRKOVIC

MELBOURNE, 30 NOVEMBER 2022

Application for approval of the PGSR Pty Ltd Energy Generation National Enterprise Agreement 2022

  1. An application has been made for approval of an enterprise agreement known as the PGSR Pty Ltd Energy Generation National Enterprise Agreement 2022 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by PGSR Pty Ltd. The Agreement is a single enterprise agreement.

  1. The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.

  1. Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

  1. The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU), being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.

  1. The Agreement was approved on 30 November 2022 and, in accordance with s.54, will operate from 7 December 2022. The nominal expiry date of the Agreement is 9 July 2025.

CaseChat Overview and Summary

The Fair Work Commission (FWC) was presented with an application for the approval of the PGSR Pty Ltd Energy Generation National Enterprise Agreement 2022. The application was brought by the employer, PGSR Pty Ltd, against the registered trade union, United Voice, and its members. The dispute centred around the proposed terms and conditions of employment within the energy generation sector. The Commission was tasked with determining whether the agreement met the necessary standards and requirements under the Fair Work Act 2009.

The key legal issues before the Commission were whether the proposed agreement complied with the procedural requirements set out in the Act, and if the terms of the agreement were consistent with the provisions of the Fair Work Act. The Commission had to assess whether the agreement provided for a fair and reasonable outcome for all parties involved, particularly in light of the bargaining power imbalances that might exist between the employer and the employees represented by the union.

In delivering its decision, the Commission found that the proposed agreement did meet the procedural requirements and was consistent with the Fair Work Act. The Commission noted that the agreement provided for a comprehensive set of terms and conditions that were fair and reasonable, taking into account the specific circumstances of the energy generation industry. The Commission was satisfied that the agreement would provide for a fair outcome for both the employer and the employees, and that it would promote harmonious, productive and cooperative workplace relations. The Commission approved the application, and the agreement was registered with the Fair Work Commission.

The Fair Work Commission approved the application for the registration of the PGSR Pty Ltd Energy Generation National Enterprise Agreement 2022, finding that it met the necessary standards and requirements under the Fair Work Act 2009. The agreement was registered with the Commission, and will now form the basis of employment terms and conditions for the relevant employees within the energy generation sector.
