Petrucci and Petrucci

In the matter of *Petrucci and Petrucci*, the wife sought interim spousal maintenance from the husband. The proceedings were before Loughnan JR in the Family Court of Australia.

The primary legal issue before the court was whether to grant the wife's application for interim spousal maintenance pursuant to section 72 of the *Family Law Act 1975* (Cth). The court was also required to determine the quantum of any interim spousal maintenance and the costs associated with the application.

Loughnan JR ordered that the husband pay the wife interim spousal maintenance in the sum of $2,339 per week, to be paid fortnightly in advance. The first payment was to be made within seven days of the order, with subsequent payments to be made fortnightly thereafter into a nominated bank account. The husband was also ordered to pay the wife's costs of and incidental to these proceedings in the sum of $8,250, payable within two months. The remaining interim proceedings were adjourned for mention at a conciliation conference scheduled for 26 August 2008.
