In proceedings before Loughnan JR, the parties, the mother and the father, were in dispute concerning the living arrangements and time spent with their child, born in April 2007. The court was required to make orders regarding the child's residence and contact with each parent.

The court considered the welfare of the child and made interim orders. The child was to live with the mother until 6 July 2009, and also spend time with the father during specified days and times until the same date. The court further ordered that handover arrangements were to be facilitated by an officer from J Organisation at W Police Station.

Crucially, pursuant to section 68L of the *Family Law Act 1975*, the court appointed an Independent Children's Lawyer for the child. The Legal Aid Commission of New South Wales was requested to arrange representation for the child, and both parties were ordered to provide all relevant documents to the Legal Aid Commission within 14 days. The proceedings were adjourned to the Judicial Registrar’s Duty List on 6 July 2009.
