The Administrative Appeals Tribunal considered an application for a Subclass 500 (Student) visa, specifically for cookery. The applicant sought review of a decision concerning their eligibility for the visa.

The primary legal issue before the Tribunal was whether the applicant had satisfied the criterion requiring evidence of Overseas Student Health Cover (OSHC).

The Tribunal was satisfied that the applicant met the OSHC requirement based on a Policy Certificate of Overseas Student Cover received on 21 December 2018. This certificate confirmed cover for the applicant for the period from 30 August 2018 to 30 November 2020. In light of this new evidence, the Tribunal concluded that the criterion was met and remitted the matter for reconsideration. The Tribunal directed that the applicant meets criterion cl.500.215 of Schedule 2 to the Regulations.
