Pearson and Pearson (No 2)

In the matter of *Pearson and Pearson (No 2)*, Benjamin J considered an application by Mr Pearson to stay a costs order previously made by the court on 6 May 2020. The dispute concerned the conditions under which this costs order would be temporarily suspended.

The central legal issue before the court was whether to grant a stay of the existing costs order and, if so, upon what terms. This required the court to determine the appropriate conditions to impose to balance the applicant's right to pursue an appeal with the respondent's entitlement to the costs awarded.

Benjamin J ordered that the costs order of 6 May 2020 be stayed, provided that Mr Pearson filed and served a Notice of Grounds of Appeal within twenty-eight days of the current order. The stay was to remain in effect until the expiry of this period if no appeal was lodged, or, if an appeal was lodged, until its determination, withdrawal, or abandonment.
