Pearce and Cole (No 4)

The Honourable Justice Cronin considered an application concerning contravention of parenting orders. The dispute involved the mother and father, who were parties to existing parenting orders made on 7 September 2009. The mother had filed a contravention application on 26 October 2009.

The central legal issue before the court was whether the mother had established a contravention of the parenting orders by the father. The court was required to assess the evidence presented by both parties in relation to the alleged contravention.

Justice Cronin dismissed the mother's contravention application. The court ordered that the mother pay the father's costs in the sum of $1157.40. Furthermore, the court specified that the second Sunday following the making of these orders would be the next relevant Sunday for the purposes of paragraph 4(a) of the parenting orders made on 7 September 2009.
