CaseChat Overview and Summary
The Administrative Appeals Tribunal reviewed a decision concerning PCA Logistics Pty Ltd's application for approval of a nomination for the occupation of Transport Company Manager. The dispute arose when the nomination was not approved, leading PCA Logistics to seek a review of this decision.
The Tribunal was required to determine whether PCA Logistics met the criteria for the approval of the nomination under the Migration Regulations 1994. Specifically, the Tribunal considered whether the nominated position and the nominee's qualifications were consistent with the requirements of the relevant ANZSCO code, whether the business's turnover and employee numbers met the thresholds specified in the applicable legislative instrument, and whether the nominee's tasks were predominantly of a complex nature, thereby avoiding certain inapplicability conditions.
The Tribunal found that PCA Logistics was an approved standard business sponsor and had lodged the nomination in accordance with the prescribed process. Crucially, the Tribunal was satisfied that the nominated occupation, Transport Company Manager (ANZSCO 149413), was genuine and not precluded by any inapplicability conditions. This conclusion was based on evidence demonstrating that the company had an annual turnover exceeding $4.8 million and employed six staff, and that the nominee performed a suite of supervisory and complex logistical duties consistent with the ANZSCO description. The Tribunal also noted that the nominee had been a vital employee since 2016 and had significantly contributed to the business's growth.
Consequently, the Tribunal set aside the original decision not to approve the nomination and substituted a decision approving the nomination.
