CaseChat Overview and Summary

Pax Australia Pty Ltd applied to the Fair Work Commission for approval of the PAX AUSTRALIA - AWU ENTERPRISE BARGAINING AGREEMENT 2015. The Australian Workers' Union sought to have the agreement approved, while the employer opposed the application. The dispute centred on whether the agreement complied with the statutory requirements of the Fair Work Act 2009. The issues for determination were whether the agreement met the good faith bargaining requirements, and if it contained provisions that were contrary to the Fair Work Act or otherwise invalid.

The Commission found that the agreement was the product of good faith bargaining between the parties, as it demonstrated a genuine attempt to negotiate in a cooperative manner. The Commission also held that all provisions of the agreement were consistent with the Fair Work Act and did not contain any invalid or unenforceable terms. Therefore, the application for approval was successful. The Fair Work Commission approved the PAX AUSTRALIA - AWU ENTERPRISE BARGAINING AGREEMENT 2015, finding that it met the statutory requirements and was a genuine outcome of good faith bargaining.
