This evidence established that the business primarily operated on a wholesale basis, not in a front-line retail setting, and that the nominee's duties, such as supervising staff, maintaining quality assurance, and liaising with suppliers, did not involve direct client transactional interaction or purchasing from suppliers, thus circumventing the specified inapplicability conditions.
Consequently, the Tribunal concluded that the applicant met all applicable criteria for the nomination to be approved. The decision not to approve the nomination was set aside, and a substituted decision approving the nomination was made.
