CaseChat Overview and Summary
This matter concerned an application for a Visitor (Class FA) visa, Subclass 600, brought before the Tribunal by Mr. Patel. The central dispute revolved around whether the applicant had satisfied Public Interest Criterion (PIC) 4005, which mandates certain health assessments for visa applicants. The delegate's decision had refused the visa on the grounds that the applicant had failed to provide evidence of a required chest x-ray and medical examination within the stipulated timeframe.
The Tribunal was required to determine if the applicant had met the requirements of PIC 4005(1)(aa), which obliges applicants in specified classes to undergo medical assessments unless a Medical Officer of the Commonwealth directs otherwise. The applicant, a female citizen of India aged 49, was subject to a requirement for a medical examination and chest x-ray for a temporary visa of six months or more, as per the relevant instrument. The delegate's decision noted a lack of evidence of these assessments at the time of the decision.
However, the Tribunal considered departmental records which indicated a "Finalised Health Requirement" and "Auto-Cleared" status as of 29 June 2020. The Tribunal interpreted this to mean that the applicant had, in fact, completed the necessary medical examination and chest x-ray. Consequently, the Tribunal found that the requirements of PIC 4005(1)(aa) were met.
Based on this finding, the Tribunal remitted the application for reconsideration, with a direction that the applicant satisfied PIC 4005(1)(aa) for the purposes of clause 600.213 of Schedule 2 to the Regulations.
