Based on this documentary evidence, the Tribunal concluded that the applicant and the sponsor were indeed first cousins, thereby satisfying clause 489.225(3)(d).

Consequently, the Tribunal remitted the application for reconsideration by the Minister, with the direction that the applicant met the criterion under clause 489.225(3) of Schedule 2 to the Regulations.
