CaseChat Overview and Summary
Pascoevale Venture Australia Pty Ltd sought review of a decision concerning the approval of a nominated position under the Direct Entry Nomination stream. The dispute centred on whether the nominated position of Marketing Specialist, to be filled by a non-Australian resident, met the requirements of the Migration Regulations 1994. The matter was heard by Warren Stooke AM.
The court was required to determine if the nominated position satisfied the criteria set out in regulation 5.19 of the Migration Regulations 1994, specifically concerning the genuineness of the need for the position, the tasks involved, and the nominator's compliance with workplace relations laws and immigration requirements. The court also needed to consider whether the nominated occupation, ANZSCO Code 225113 Marketing Specialist, was appropriate for the duties described and if the nominator had a satisfactory record of compliance.
The court reasoned that the evidence presented, including the duties of the nominated position, the applicant's financial status, and the organisational chart, demonstrated a genuine need for the Marketing Specialist role within Pascoevale Venture Australia Pty Ltd. The court found that the tasks described corresponded to the nominated occupation and that the nominator had met its obligations regarding workplace relations laws, including providing appropriate employment terms and conditions and contributing to superannuation. Furthermore, the court was satisfied that there was no adverse information known to Immigration concerning the nominator and that the nominator was actively and lawfully operating its business in Australia.
Consequently, the Tribunal set aside the original decision and substituted it with a decision approving the nomination of the position.
