Pascall and Pascall

In the matter of *Pascall and Pascall*, O'Reilly J made orders by consent on 19 and 20 October 2010 concerning property settlement and spousal maintenance. The dispute involved the division of assets and the provision of financial support between the husband and wife.

The court was required to determine the terms of interim orders regarding the distribution of share sale proceeds, the characterisation of payments made from those proceeds, and the provision of interim spousal maintenance. The court also considered the wife's amended application for interim orders, dismissing it in part.

The orders reflected a consent arrangement between the parties. The husband was directed to secure payment of $225,000 from a share transfer agreement, which was then to be paid into a trust account. From this sum, each party was to receive $50,000 by way of a Hogan order, to be characterised as a partial property settlement at trial. The remaining balance was to be held on trust and used to pay interim spousal maintenance to the wife of $1630 per week, commencing on 26 October 2010. The characterisation of these maintenance payments as interim spousal maintenance or partial property settlement was reserved for trial. The wife's amended application for interim orders was otherwise dismissed. The question of costs was reserved for the trial judge.
