This matter concerned an application for a Temporary Business Entry (Class UC) visa, Subclass 457 (Temporary Work (Skilled)), before the Tribunal. The applicant sought review of a decision that had been made in relation to their visa application.

The primary legal issue before the Tribunal was whether the applicant met the criteria for a Subclass 457 visa, specifically in relation to the nomination requirements. The Tribunal was required to determine if the nomination for the applicant's occupation had been approved and if the other associated criteria under clause 457.223 of Schedule 2 to the Regulations were satisfied.

The Tribunal found that while the initial decision may have proceeded on the basis of an unapproved nomination, the nomination was subsequently approved upon review. Consequently, the Tribunal remitted the application for the visa to the Minister for reconsideration. The Tribunal directed that the applicant be considered to meet the criteria outlined in subclause 457.223(4)(a) of Schedule 2 to the Regulations, allowing for the assessment of the remaining visa criteria.
