CaseChat Overview and Summary

The Australian Securities and Investments Commission (ASIC) issued summonses for the production of documents to Mr. Panayiotides and other parties. Mr. Panayiotides objected to these summonses, arguing they were manifestly irrelevant, overly broad, oppressive, and caused stress and difficulty. The dispute before the Tribunal concerned whether these objections were valid and whether the summonses should be set aside or varied.

The primary legal issues before the Tribunal were whether the summonses were appropriate in their breadth and whether the objecting parties could successfully apply to set them aside. The Tribunal also had to consider the extent to which the summonsed parties were required to obtain documents from agents and the implications for any expenses incurred in doing so. Furthermore, the Tribunal needed to determine the conditions under which any produced documents would be made available for inspection by ASIC.

Deputy President Rayment P, in his decision, expressed doubt as to whether the summonses should be set aside. He directed that if the named persons located documents within their possession that fit the descriptions in the summonses, or could obtain them without expense from an agent, they were to be produced to the Tribunal for examination prior to a hearing. The Deputy President indicated that he would determine at the hearing whether procedural fairness required ASIC and its advisers to be granted access to the documents, or some of them. Until further order, no access would be granted to any person, and consequently, no order was made to vary the breadth of the summonses or to set them aside.
