Pan (Migration)

The Administrative Appeals Tribunal (AAT) considered an application by Mr Pan for a Contributory Parent (Class CA) visa, specifically a Subclass 143 (Migrant) visa. The core of the dispute concerned the adequacy of the Assurance of Support provided by the applicant.

The Tribunal was required to determine whether the applicant met the criteria for the Subclass 143 visa, particularly in relation to the Assurance of Support. The Tribunal also had to consider whether a hearing was necessary for the determination of the application.

The Tribunal found that it was able to determine the application in favour of the applicant without a hearing, pursuant to section 360(2)(a) of the Migration Act 1958 (Cth). The Tribunal remitted the application for reconsideration with a direction that the applicant meets the criteria under clause 143.228 of Schedule 2 to the Migration Regulations 1994 (Cth).
