Pamplin and Pamplin (Costs)

In *Pamplin and Pamplin (Costs)*, Warnick J of the Federal Circuit Court of Australia considered applications for costs following earlier proceedings between a husband and wife. The dispute concerned the division of property and associated costs.

The court was required to determine the appropriate orders for costs in relation to several applications filed by the parties. Specifically, the court had to decide whether costs should be awarded, and if so, to what extent, for the application filed on 17 September 2007, the applications filed on 11 March 2008 and 3 December 2008, the application for property settlement, and the application for costs heard on the day of the decision.

Warnick J ordered that the wife pay the husband’s costs in relation to the application filed on 17 September 2007, and one third of the husband’s costs for the property settlement application and the costs application heard on the day of the decision. However, there were to be no orders as to costs for the applications filed on 11 March 2008 and 3 December 2008. These costs were to be agreed between the parties or, in default of agreement, assessed.
