Palmer v The Queen

In *Palmer v The Queen*, the High Court of Australia considered an appeal by the applicant, Palmer, against his conviction for murder. The applicant had been found guilty of murder by a jury in the Supreme Court of Queensland and subsequently appealed to the Court of Appeal of Queensland, which dismissed his appeal. The central dispute concerned the admissibility of certain evidence and the directions given by the trial judge to the jury.

The High Court was required to determine whether the trial judge had erred in admitting evidence of the applicant's prior convictions and whether the judge's summing up to the jury contained misdirections that rendered the conviction unsafe or unsatisfactory. Specifically, the court had to consider the principles governing the admission of evidence of prior convictions, particularly where such evidence might be considered prejudicial, and the proper application of the law relating to self-defence in the context of the trial judge's directions.

The Court held that the admission of evidence of the applicant's prior convictions was improper and prejudicial, as it did not fall within any of the recognised exceptions to the general rule against admitting such evidence. The prior convictions were not relevant to any issue in the trial, nor did they demonstrate a system of conduct or a relevant disposition. Furthermore, the Court found that the trial judge's directions on self-defence were inadequate, failing to properly explain the relevant legal principles to the jury. Consequently, the High Court concluded that the conviction was unsafe and unsatisfactory due to these errors.

The High Court allowed the appeal, quashed the conviction for murder, and ordered a new trial.
