Palani (Migration)

The Administrative Appeals Tribunal affirmed the decision to cancel the Subclass 476 (Skilled - Recognised Graduate) visa held by the applicant, Mr. Palani. The cancellation was based on the applicant providing bogus academic transcripts and an award qualification, which constituted the provision of incorrect information on his visa application form.

The Tribunal was required to determine whether the applicant had failed to comply with the requirements of the *Migration Act 1958* (Cth) as notified under section 107, and whether, in light of all the relevant circumstances, the visa should be cancelled.

The Tribunal found that the applicant had indeed failed to comply with the Act by submitting fraudulent academic documentation. Applying the principles of visa cancellation for providing incorrect information, the Tribunal concluded that the circumstances warranted the affirmation of the delegate's decision to cancel the visa. The Tribunal therefore affirmed the decision to cancel Mr. Palani's visa.
