The Administrative Appeals Tribunal (AAT) considered the application of Mr Prit Pal and Ms Bhawna Sharma concerning a Temporary Business Entry (Class UC) visa, subclass 457. The dispute arose from the refusal to grant the visa to Ms Sharma, with Mr Pal acting as the sponsor.

The primary legal issue before the Tribunal was whether it had jurisdiction to consider the application for review in relation to Mr Pal, and whether Ms Sharma met the criteria for the visa. Specifically, the Tribunal had to determine if Ms Sharma could satisfy the requirements of cl.4547.321 of the Migration Regulations given the circumstances of her husband's visa status and the refusal of the nomination.

The Tribunal found that based on the evidence presented, Ms Sharma could not satisfy the requirements of cl.4547.321. The Tribunal further determined that it did not have jurisdiction to consider the matter in relation to Mr Pal. Consequently, the Tribunal affirmed the decision not to grant Ms Bhawna Sharma a Temporary Business Entry (Class UC) visa.
