Consequently, the court did not proceed to consider the merits of the Owners Corporation's arguments regarding the sequestration order or the alleged breach of duty by the trustee.

The application for an extension of time was dismissed, and therefore the Owners Corporation was not permitted to make its application for review out of time. The sequestration order made by the Registrar against Mr Watson stood.
