CaseChat Overview and Summary
The central legal issue for the Commission to decide was whether the proposed enterprise agreement met the criteria for approval under the Fair Work Act. This included whether the agreement had been made in good faith and whether it provided for terms and conditions that were not less favourable than the applicable award or safety net award. The Commission also had to consider whether the agreement had been made in accordance with the procedural requirements of the Act.
The Fair Work Commission determined that the proposed enterprise agreement did meet the criteria for approval. The Commission found that the agreement had been made in good faith and contained terms and conditions that were not less favourable than the applicable award or safety net award. Furthermore, the Commission was satisfied that the agreement had been made in accordance with the procedural requirements of the Act. As a result, the Commission approved the proposed enterprise agreement.
The final orders of the Fair Work Commission were that the Otis Elevator Company Pty Ltd (Victoria) - Construction & Service Employees Enterprise Agreement 2019 be approved as a registered agreement. This decision was made on the basis that the agreement met the criteria for approval under the Fair Work Act and was in the best interests of the employees covered by the agreement.
