The parties in this matter were Mr and Ms Osten, and the dispute concerned an application for liberty to search and inspect court documents from separate proceedings. The Honourable Justice Johns of the Family Court of Australia heard the application.

The primary legal issue before the Court was whether the parties should be granted permission to access and copy documents from a previous Family Court proceeding, specifically Family Court proceedings number MLC 4991 of 2011 between Mr Becker and Ms Becker, referred to as "the Becker file". A secondary issue was the extent to which the parties should be permitted to use the information contained within that file.

Justice Johns ordered that the parties be at liberty to search, inspect, and copy the Becker file for the sole purpose of the issues in dispute in the current proceedings. Crucially, the Court also ordered that the parties be restrained from using the information obtained from the Becker file for any purpose other than the resolution of the issues in the present proceedings.
