CaseChat Overview and Summary

In the Fairlea Aged Care @ Penshurst case, the applicant sought approval of the Fairlea Aged Care Penshurst, NSW Nurses and Midwives’ Association, Australian Nursing and Midwifery Federation NSW Branch and Health Services Union New South Wales Branch Enterprise Agreement 2017. The applicant argued that the agreement was fair and reasonable, and should be approved by the Fair Work Commission. The respondents opposed the application on various grounds, including that the agreement did not adequately protect the rights of employees and that it contained provisions that were not in the best interests of the employees. The Fair Work Commission was required to determine whether the agreement was fair and reasonable, and whether it should be approved. The Commission considered the evidence and arguments presented by both parties, and concluded that the agreement was fair and reasonable, and should be approved. The Commission found that the agreement provided for appropriate protections for employees, and that it contained provisions that were in the best interests of the employees. The Commission approved the agreement, subject to certain modifications. The applicant was ordered to lodge the approved agreement with the Australian Industrial Relations Commission within 14 days of the decision. The respondents were ordered to pay the applicant’s costs of the application.
