Onyemairo (Migration)

The Administrative Appeals Tribunal considered an appeal by Mr Onyemairo against the cancellation of his Subclass 500 (Student) visa. The visa had been granted by the Department of Home Affairs' post in Pretoria, South Africa, but an investigation revealed that departmental employees may have improperly processed a tranche of visas, including Mr Onyemairo's, potentially bypassing standard procedures. The primary legal issue before the Tribunal was whether the ground for cancellation under s 116(1)(g) of the Migration Act 1958 (Cth), read with regulation 2.43(1)(o) of the Migration Regulations 1994, was established. This required the Tribunal to be satisfied that a prescribed ground for cancellation applied to the applicant, specifically concerning the circumstances of his visa grant. If satisfied that the ground existed, the Tribunal then had to consider whether to exercise its discretion to cancel the visa, taking into account all relevant circumstances.

The Tribunal found that the ground for cancellation was established, being satisfied that the applicant's visa was among those improperly granted due to potential corruption by local departmental employees. While this ground did not mandate cancellation, the Tribunal proceeded to consider its discretion. It weighed factors including the applicant's enrolment in a Certificate IV in commercial cookery, which the Tribunal viewed as not a logical progression from his biochemistry degree, his compliance with visa conditions, and the hardship that cancellation would cause to his Australian citizen partner and their young child. Despite acknowledging the hardship, the Tribunal concluded that the circumstances as a whole warranted the cancellation of the visa.

Consequently, the Tribunal affirmed the decision to cancel Mr Onyemairo's Subclass 500 (Student) visa.
